California Homebuyers Tax Incentive Funds Depleted … Should We Increases Taxes and Fees to Pay More?

California legislators put a hundred million dollars on the table for first time homeowners to grab.  Were they surprised when takers actually accepted the offer?  Apparently this is so.  They are now attempting to put more money in the coffers for this give-away.

The program is a tax credit that spreads across three years, in three equal payments, for buyers of new homes.  The definition of new home is that it must be a single family residence, detached or attached, and never previously occupied.  After purchase, the buyer must occupy the property for a minimum of two years and receives a credit of $10,000, or 5% of the price, whichever is less.

The program, passed in February 2009, put up one hundred million dollars for this incentive.  Amazingly, this money was offered during a time when the state of California is, by some measures, bankrupt!

Now, there are two new bills pending in Sacramento that would add an additional $200-$300,000,000 to this program.  In my opinion the original bill was unconscionable, considering the state of the California economy.  To double or triple the original giveaway is totally incomprehensible.

These actions should definitely earn California an award for the greatest “tax and spend” state in our short history.  Why does this bill only apply to new homes?  If the state of California really wanted to help out the real estate market, why wouldn’t this bill apply to any home purchase?

It may be cynical, but could it be this just applies to new homes because the California new home builders contribute millions to the reelection campaigns of our state legislators? What would be extremely interesting, would be to look at the public record in one year from now to see how many state legislators who backed this program, received campaign contributions from new home builders.

For California homebuyers, especially first-time buyers, that qualify for the federal $8,000 credit as well as the California $10,000 credit, this is a great deal.  But, is it really fair that tax payers are picking up the tab?  Would it not make common sense if California wanted to pass such a program, to have it apply to all home purchases in order to reduce the current oversupply of existing homes?  This program is doing nothing to lessen the supply of existing homes, vacant homes and bank foreclosures.

If this new buyer’s credit and pending new bills to escalate the funding, are not enough evidence that the California legislators ought to stay out of the real estate industry, perhaps remember what other mischief they’ve done.  Mischief with good intentions and negative results is still mischief.  These good folks extended the foreclosure process by 30 days in 2008, and then when that didn’t seem generous enough, added another 90 days (California housing) this year.  When you add up all the legal requirements, our legislators are practically offering almost a year of living “mortgage-free.”  Are these California real estate laws really fair to the tax payers of California?

With an estimated 80 percent of California employers performing background checks on potential employees, it is increasingly important for employers and employees to know how criminal history can be used in hiring decisions. Misusing information about a potential employee&’s criminal history can result in the employer getting a criminal history of his or her own.

The first distinction that needs to be drawn is that between arrests, charges, and convictions. After an investigation of a possible crime, an arrest is normally the next step in the criminal process. An arrest can occur when law enforcement believes there is probable cause that a suspect has committed a crime. Upon that arrest, the state may decide to file charges with the court and prosecute the suspect. A conviction only occurs after a suspect has plead guilty or no contest (nolo contendre), or is found guilty by the court.

An employer is generally permitted to ask about an applicant’s criminal convictions or any pending charges. However, in most circumstances, California law (Labor Code section 432.7) prevents employers from asking an applicant to disclose arrests that did not lead to convictions or where a diversion program was completed. There is also a unique exemption that allows an applicant not to disclose marijuana possession convictions that are two or more years old. Furthermore, an employer cannot inquire about a conviction that has been expunged, sealed, or eradicated. These laws also apply to employers who are considering a current employee for promotion or termination.

In some very limited circumstances, California Labor Code allows an exception for an employer to ask about arrests that did not lead to convictions. For example, an employer may ask an applicant to disclose any drug-related arrests if the applicant would have access to medication as a part of his or her job duties. Another exception occurs when a medical facility asks the applicant to disclose sex-related offenses where the position allows access to patients. An employer may also ask you to disclose an arrest that you are currently out on bail for.

If you are applying for a position as a peace officer or are currently a peace officer, you may be asked to disclose an arrest. However, you may not be discharged or denied employment based on that arrest without further investigation.

A violation of the above laws, excluding those covering peace officer employers, may result in civil and criminal liability. If an employer has unintentionally violated the above laws, an applicant may recover personal damages, costs, and reasonable attorney fees. An intentional violation of the above laws entitles the applicant to triple the amount of personal damages, costs, and attorney fees. An employer who intentionally misuses criminal data may end up with a criminal record of their own as abuses can be prosecuted as a misdemeanor.

U.S. home foreclosure filings set a new record high in April, 2008, increasing by 65% over the previous year and placing municipalities at risk by cutting into the value of taxed property on their tax roles. The U.S. Foreclosure Market Report was released on May 14,2008 by RealtyTrac, an online marketplace that tracks foreclosed properties.

There are still quite a few optimists about who seem to think that the worse of the financial crisis is over. This would include US Secretary of the Treasury, Hank Paulson. Current data suggests otherwise and that foreclosures will continue to increase over the next year to 18 months. It is hard to see the US economy doing well when massive numbers of foreclosures are dragging down the value of the entire US housing market.

Municipalities in the hardest hit states like California, Nevada, and Florida are having their revenues drastically cut as tax revenues plummet. Foreclosed properties reduce the value of taxed properties. Plunging home values reduce the money that cities, villages and towns collect in property taxes and is causing yet another financial crisis.

The April foreclosure rate is “the highest monthly total we’ve seen since we began issuing the report in January 2005,” said chief executive James J. Saccacio in a statement. “The city council in Vallejo, California, part of a metropolitan area with a foreclosure rate that ranked sixth highest in the nation in April, voted last week to have the city file for bankruptcy,” said Saccacio.

The gross over extension of mortgage debt, credit card debt, and business debt, that has occurred over the past twenty five years, is not going to be corrected overnight. As debt is deleveraged the consequences of the real estate bubble popping are going to be with us for a very long time.

The stock market has held up well so far due only to the tremendous injection of liquidity into the banking and stock brokerage system by the Federal Reserve Bank. As a result stock market investors have not faced up to the reality that housing market conditions continue to deteriorate and so far think that the mortgage crisis will be short lived.

This rosy perception is likely to be reexamined and discarded as the foreclosure rate continues at high levels. As real estate values continue to plunge banks are going to come under increasing pressure. It seems to me that using current stock market rallies to sell stocks is the most prudent course of action.

When it comes to real estate investing and bottom picking of selected properties the best values are probably yet to come. Housing prices are likely to fall even further over the next year or two. So far in 2008 , according to the National Board of Realtors (trademark), housing prices have declined by 7.7%.

The important thing to keep in mind is that this is not an ordinary economic slow down or recessionary period. The over extension of credit, high debt levels, and the misallocation of capital, build up over many years. The correction will probably be long and severe.

The fact that the Fed actions of pumping even more credit into a system that is ill because of too much easy credit is not reassuring. The commodity bubble may be the most dangerous bubble of them all as excess liquidity is helping to send prices for stable commodities like wheat, corn, soybeans, and rice to record levels. Food riots are already breaking out around the world as billions of poor people are being priced out of being able to eat at adequate levels. Even in the United States centers which assist low income people with food supplies are trying to cope with nearly bare warehouses.

While the Fed may have calmed the waters in the fat cat banking and stock brokerage communities it may have set the stage for violent conditions and food riots that will bring down governments across the world.

As additional foreclosures take place the additional financial strains placed upon the international banking system may cause the Fed and other central banks to keep inflating the money supply at rates leading to hyperinflation. This would cause even higher prices for commodities than we are presently experiencing, reinforcing a vicious feedback loop.

The resulting food price inflation would be hugely destabilizing. When a large number of a countries population is starving anything can happen. A great deal more trouble for the world’s financial and political systems is almost certainly on the way.
